A Harare man has been sentenced to 36 months in prison after he was found guilty of culpable homicide, the National Prosecuting Authority (NPA) is reporting.
Tinashe Macheka (27) of Harare has been arraigned by the Harare Magistrates’ Court for cupable homicide after a tragic accident on 27 October 2024.
The court heartd that Macheka drove a Honda Fit without a valid license, losing control near Stable Club, Mazowe Road. The vehicle overturned killing four-year-old Julia Tendai Mundandi on the spot.
Macheka was driving the care without patience.
With respect to the driving the particulars of negligence are as follows:
a) failure to take proper control of the vehicle
b) failure to have a proper lookout on the road
c) failure to stop or act reasonably when accident seemed imminent
Macheka pleaded guilty.
He was sentenced 36 months imprisonment 12 months suspended for five years. He will effectively serve 24 months.
Elsewhere, a 59 year-old man from Nyatsime was brought before the Chinhoyi Magistrates’ Court on a negligent driving charge.
The court was told that on the 10th of May 2024, the accused person was driving a Toyota Hiace with
twelve passengers on board along Harare -Chirundu road when he encroached into the opposite lane and collided with a Honda Airwave which had nine passengers on board.
One passenger aboard the Honda Airwave sustained injuries.
The particulars of negligence are as follows:
a) Failing to keep proper lookout
b) Failing to stop or reasonable when the collission was imminent.
c) Travelling at speed which was excessive in the circumstances.
The accused person was sentenced to pay USD200 fine or face 4 months imprisonment in default of payment. His license will be endorsed (penalty points to be added).
